Discussing your loved one's taxes

We can only discuss your loved one's tax affairs with the executor/administrator of the estate. This may be you, a tax agent, a solicitor or a trustee company (eg, the Guardian Trust or Public Trust). The executor/administrator can receive information about the estate and/or update the account only if we hold written confirmation that they're the executor/administrator.

If there's no executor/administrator of the estate please contact us to confirm what we can do in this situation.

ACC and insurance payments

You may need to provide your income details to ACC or your insurance company. You can get these details:

  • at "Secure online services" - go to the top right side of this page
  • by calling us on 0800 473 566, or
  • by coming into our Greymouth office and speaking to one of our team.

ACC may also need your child/children's IRD number(s). If your child/children have an IRD number but you can't remember it, please call us on 0800 473 566 for this information.

If you need to apply for an IRD number for your child/children you'll need to complete an IRD number application - individual (IR595) form for each child and give this to us with your child's birth certificate and two forms of identification listed on the back of the IR 595. We can issue an IRD number within 24 hours.

ACC payments

No tax needs to be deducted from any funeral grant, survivor's grant or childcare payments you may receive from ACC.

You may be entitled to weekly compensation from ACC. ACC will deduct PAYE and other deductions like student loan and KiwiSaver (if required) from these payments. You'll need to complete a Tax code declaration (IR330) showing ACC what tax code to use.

When you complete the IR330 for ACC you'll need to put your name and IRD number on the form because these payments are made to you. If the ACC payment is your main income then you should use one of the M tax codes. If you receive employment income from elsewhere, you should use one of the S tax codes for the ACC payments. Working for Families Tax Credits

If you have a child or children you may be entitled to Working for Families Tax Credits (WfFTC). You can apply for WfFTC on the Working for Families' website.

WfFTC is based on your yearly income. If you already receive WfFTC your entitlements may change. You can re-estimate your yearly income at "Secure online services" (go to the top right side of this page) or by calling us or your tax agent

Student loan

If your loved one had a student loan you don't need to repay the loan, it will be written off. The student loan team will usually need to sight the death certificate before the loan is written off. You can send a copy of the death certificate to:

KiwiSaver

If your loved one was a KiwiSaver member their KiwiSaver savings will be paid to their estate. You or the executor/administrator of the estate will need to contact their KiwiSaver scheme provider to arrange this. If you're unsure who their KiwiSaver scheme provider is, the executor/administrator should contact us.

Child support

If your loved one was paying child support their estate will pay any child support debts they may have. If the estate can't pay these debts they'll be written off. You won't have to make any more child support payments.

If they were receiving child support payments for their child and that child is now in your care, you'll need to apply for child support payments by completing a Child support formula assessment application (IR101) form.

Filing tax returns

If your loved one wasn't required to receive a personal tax summary (PTS) or file an Income tax return (IR3) then you won't have to request/file one on their behalf.

If they would have filed an IR3, their estate will need to file a tax return on their behalf.

If they weren't required to receive a PTS or file an IR3 but you think they were entitled to a refund, please contact us.

If they were entitled to a refund and you want it to be paid to you, you'll need to complete a Statutory declaration in support of application for refund (deceased person) (IR625) and have it witnessed by a solicitor or Justice of the Peace, or Officer authorised to take statutory declarations.

If the estate will continue to receive income, the executor/administrator will need to get an IRD number for the estate by completing an IRD number application - non-individual (IR596).The estate will also need to complete an Estate or trust income tax return (IR6) each year.
